The Property, Owner and Guests
The property known as Beach House Rosevine, Rosevine, Truro, Cornwall TR2 5EW (the Property) is offered for holiday rental subject to confirmation by Liz Whitaker and Peter Hill (the Owner) to the renter (Guests). Beach House Rosevine is a one-bedroom property and car-parking space available for two 16+ adults (plus one baby/infant) and/or one well-behaved dog or cat.
Rates
A current price list is available on www.beachhouserosevine.com and day rates vary according to season. You will be advised of the total fees, including any discounts and all payment dates and details in your confirmation of reservation email.
Reservations and Payment Schedules
There is no booking fee for Beach House Rosevine and there are different payment schedules according to type of guest as outlined below.
For the avoidance of doubt, a reservation applies to us confirming a specific date slot for you. The reservation becomes a booking when the Guest makes a first payment. This is when the terms and conditions apply and a binding contract comes into existence between us.
Friends of Beach House (regular guests of 5+ years and others at the discretion of the owners) - Your reserved annual week(s) will be kept for you until six months before the start date at which time we will email to request a 50% deposit payable by bank transfer within 14 days. In the event of non-payment within 14 days, the week(s) will be released to our waiting list. The remaining 50% is payable three months before your start date. In the event of non-payment the week(s) will be released to our waiting list/social media/Airbnb and your deposits will be refunded as long as we are able to re-let the week(s).
Other Guests – We kindly request a 50% deposit (non-refundable subject to conditions outlined below), at the time of booking, to secure your reservation. We will email you six months in advance to request 50% of the remainder payable by bank transfer within 14 days. In the event of non-payment the week(s) will be released to our waiting list/social media/Airbnb and your deposits will be refunded as long as we are able to re-let the week.
All Guests - Your booking is made as a consumer for the purpose of a holiday and you acknowledge that no liability can be accepted for any business losses howsoever suffered or incurred by you. This occupation does not create any form of legal tenancy or licence and is strictly only on the basis of a short-term holiday. We reserve the right to refuse any booking prior to the issue of our written confirmation.
Reservations made within twelve weeks of the start of the rental period require full payment at the time of booking.

You should carefully check the details of our reservation and confirmation details and inform us immediately of any errors or omissions.
Airbnb Guests
Airbnb terms and conditions for booking, payment, cancellations apply to Airbnb guests. In all other aspects, including our cancellations and refunds policy, Airbnb guests must adhere to these terms and conditions and they apply on payment of your booking to Airbnb.
Cancellations and Refunds
We recognise that sometimes guests have to cancel or change their holiday for unforeseen reasons. Please give us as much notice as possible so we can re-book your week and return any payments. We will also do our best to move your week to another time in the same holiday year and will advise on any payment differentials for that changed week. We do not transfer cancelled holidays to a future year.
In the event of non-payment of the balance for your booking, we will consider the booking cancelled. You remain liable to pay the balance of the rent unless we are able to re-let the Property. You will receive a full refund if we are able to re-let the Property. Any expenses or losses incurred in so doing, including our time at £50 per hour, will be deducted from the refundable amount.
If there is a Government enforced lockdown (either the whole of the UK, Cornwall or where you live) due to Covid-19 (or similar virus), you will be given a full refund.
The Owner will endeavour to make sure Beach House Rosevine is available for the dates contracted. In the unlikely event the property becomes unavailable and the property owner has to cancel the booking, the Guest shall be entitled to a full refund. The Owner shall only be liable to return the monies received. No compensation or consequential losses shall be paid.
Communication
The Owner will communicate with you by email at various stages from reservation, booking and follow-up as outlined above. However, from time to time, the Owner may also use phone, text or WhatsApp to communicate with the Guest. Accordingly, the Owner will keep contact details including emails and phone numbers on the booking system for the sole purpose of your holiday booking and/or advising the Guest of developments at Beach House Rosevine.
The Guest is entitled to communicate with the Owner and or the Property Manager by email, phone, text or WhatsApp or social media.
Insurance
Guests are advised to arrange their own comprehensive travel insurance policy (including cancellation cover) providing full cover for all members of the party and their personal belongings, public liability etc., since the Owner shall not be responsible for any injury, loss or damage suffered by a member of the party and such risks are not covered by the Owner’s insurance policy.
Rental Period
The rental period shall commence at 4.00 p.m. on the first day (unless otherwise agreed and confirmed) and finish at 10 a.m. on the last day. The Owner is not obliged to offer access to the Property before the time stated and the Guest is not entitled to remain in occupation after the time stated.
Numbers and Facilities
The maximum number of people to reside in the Property must not exceed two adults plus one baby/infant (unless there are exceptional circumstances which must be approved by the Owner).
The Guest has use of a designated and signposted car parking space in the open garage adjacent to the property. Unless there are mitigating circumstances, the Guest agrees to use this space and not park a car in a way that obstructs other vehicles or the view and enjoyment of other properties.
Guests use the car parking spaces and the drive area entirely at their own risk. The Owner is not liable for any damage to, theft or theft from a Guest vehicle during their stay at the Property.
Guests are not allowed to park a motorhome or caravan, or erect a tent in the garden, to use as extended accommodation.
Guest’s visitors are allowed to use the guest car parking spaces.
The e-charging facilities are for the exclusive use of all guests in the five cottages following the instructions given and are used entirely at the risk of the Guest. The Beach House electric supply must not be used to charge your vehicle. A fine of £500 will apply to any Guest breaking this rule.
Dogs
The Owner will accept one well-behaved dog for an extra fee of £50 per week. There are some specific requests for dog owners which will be sent in advance. These include any Guest with a dog must take special care to keep the dog off the furniture, off the bed and should not be allowed to scratch or damage the house. The Guest should leave the accommodation as they found it, including removing any dog mess from the garden. Guests with dogs also agree to be considerate of neighbouring properties and not allow their dogs to roam or make undue noise. The Owner reserves the right to request compensation for the repair of any damage caused by dogs including unnecessary soiling. Dog owners with badly behaved or messy dogs will be barred for re-booking Beach House Rosevine.
Smoking and Fire Risk
Beach House Rosevine is a NO SMOKING house. The Guest agrees that no one in his or her party will smoke inside the house.
Beach House Rosevine is required to follow strict guidelines on the prevention of fire and the safety of guests in the event of a fire. There are smoke and carbon monoxide alarm, a fire hydrant, a fire blanket and lighting that will activate in the event of a fire. Because of the fire risk, candles are also prohibited (note that battery operated candles are provided). It is the Guest’s responsibility to ensure they are aware of these facilities.
Taking Care of the Property
The Guest agrees to be a considerate tenant and to take good care of the Property, including following the rules on waste disposal and the septic tank, and to leave it in a clean and tidy condition at the end of the rental period, including emptying the fridge and dishwasher, removing all personal items, cleaning the cooker and placing all rubbish in the Beach House bin provided (for private collection – information supplied in Reception details) while taking recycling home, turning off any electrical items, turning down radiators and returning the key to the place from which it was collected.
The housekeeper provides the owner with a rating on how well the guests have looked after Beach House and how they left it. The owner will share this rating with the guest (with any photographic evidence if necessary) Please note that, to respect the large majority of guests who look after Beach House, guests with poor ratings are banned from future bookings.
The Guest agrees not to act in any way that would cause disturbance to residents in neighbouring properties.
The Guest agrees to report to the Owner’s Property Manager, Rosie Jacomb, without delay any defects in the Property or breakdown in the equipment, plant, machinery or appliances in the Property or garden, and the Owner will make arrangements for repair and/or replacement will be made as soon as reasonably possible. If defects are not reported, there is a possibility that any damage may be deemed to have been caused by the Guest. The Guest shall also report any breakages they cause so the Property Manager can secure a timely replacement. Compensation to the Owner is determined on a case-by-case basis.
The Guest shall observe the safety advice and rules in these Terms & Conditions and in the guest information held in the Property.
Miscellaneous Liabilities
The Owner shall not be liable to the Guest:
- For any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliances in the Property or garden.

For any loss, damage, or injury which is the result of adverse weather conditions, riot, war, terrorism, industrial disputes or other matters beyond the control of the Owner.

For any loss, damage or inconvenience caused to or suffered by the Guest if the Property shall be destroyed or substantially damaged before the start of the rental period and, in any such event, the Owner shall, within seven days of notification to the Guest, refund to the Guest all sums previously paid in respect of the rental period.
Under no circumstances shall the Owner’s liability to the Guest exceed the amount paid to the Owner for the rental period.
Governing Law
The contract between the Owner and Guest is governed by the law of England and Wales and we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Courts of England and Wales.
